Divorce or Legal Separation
Following a divorce or an annulment, you will be able to—and in certain cases, you must—make changes to benefit plans outside of Open Enrollment. A copy of the divorce decree is required.
If your former spouse or stepchildren are enrolled in the IU dental plan and/or medical plan, they are no longer eligible and you must remove them.
The change must be made within 30 days of the divorce or annulment date.
To make changes to any of the plans listed immediately below, you will need to
request a Family Status Change through the Employee Center on OneStart and
complete online enrollment of your changes once your request is approved by HR. You must make the change within 30 days.
- Remove your former spouse or stepchildren from your IU dental plan.
- If you are currently covered under your spouse's dental plan, enroll yourself and your children in the IU dental plan.
- Remove your former spouse or stepchildren from your current IU medical plan.
- If you are currently covered under your spouse's medical plan, enroll yourself and your children in an IU medical plan.
Personal Accident Insurance plan
- Add or drop coverage.
- Increase or decrease the coverage level.
Health Care:
- Decrease election if consistent with change.
Dependent Care:
- Add or increase coverage if the divorce creates or increases need for dependent care.
- Drop or decrease coverage if the divorce decreases or eliminates the need for dependent care.
(Consistency rule is satisfied if change corresponds with Family Status Change that affects either eligibility for coverage under Plan or eligibility of expenses under applicable IRS regulations.)
